
The Court of Appeals of Tennessee in Jackson has affirmed the judgment of the Obion County Circuit Court involving a South Fulton cheerleader injury.
The case arose after 16 year old South Fulton cheerleader Courtney L. Wherry fell and injured her neck, while performing a “shoulder sit” prior to a football game in August of 2019.
Wherry and her parents, Jason T. Wherry and Jaime Tidwell brought suit against the Obion County Board of Education and Obion County School District to recover damages for injuries sustained.
The Wherry’s based two negligent theories that included the hiring of South Fulton High School cheerleading coach Nichole Harrell, along with acts and omissions of Ms. Harrell related to Wherry’s injuries due to field conditions.
Following a bench trial in Obion County Circuit Court, the court found in favor of the School District on both negligent theories.
The Court of Appeals decision supporting the Circuit Court decision was filed on Monday.
