Governor and Others Sued over National Guard Deployment in Memphis

A group of Memphis-area lawmakers are suing Tennessee Gov. Bill Lee over the deployment of the National Guard to the city of Memphis.

In a lawsuit, obtained by The Commercial Appeal, multiple plaintiffs, all elected officials, claim the deployment of the National Guard violates the Tennessee Constitution.

The 24-page lawsuit was filed October 17th in Davidson County Chancery Court.   Shortly after the lawsuit was filed, Chancellor Patricia Head Moskal denied the request for a temporary restraining order or temporary injunction.

She ruled the “Plaintiff’s attorneys also have not certified efforts to give notice to defendants or reasons why notice should not be required.” Though denying the motion for an immediate restraining order, she set a hearing for November 3rd to have both parties argue the merits of a temporary injunction. The hearing will take place in Nashville.

The lawsuit officially sues Lee, Tennessee Attorney General Jonathan Skrmetti and Major General Warner Ross III, the adjutant general of the Tennessee National Guard.
